1. General Disclaimer

Chipon Alert ("the App") is provided by Jyv Tech LLC (global) and its Nigeria subsidiary Tanta Innovative Limited ("Company," "we," "us," "our") on an "as is" and "as available" basis without warranties of any kind.

The App contains informational and educational content only. We do not provide professional security, legal, emergency management, or risk assessment services. Any reliance on the App is at your sole risk.

By using Chipon Alert, you acknowledge that you have read, understood, and agree to be bound by this disclaimer.

2. No Safety Guarantee

The App does NOT guarantee your safety.

Safety scores, heatmaps, incident heat mapping, neighborhood safety ratings, and route safety recommendations are algorithmically generated from community-sourced reports and third-party data sources. These calculations are informational only and are not:

• Verified by trained professionals
• Real-time or continuously updated
• Complete or comprehensive
• Predictive of future safety conditions
• A substitute for personal judgment or professional security assessment

The absence of reported incidents in an area does NOT mean that area is safe. Areas with low incident reports may have unreported risks, low community participation, or biased reporting patterns.

Areas with high incident reports may have improving conditions that our data has not yet captured.

You must always exercise independent judgment when deciding where to travel and how to get there.

3. Not Emergency Services

Chipon Alert is NOT a substitute for emergency services.

The App is not monitored 24/7 and cannot dispatch emergency responders.

In case of emergency, immediately contact:

• Ambulance/Medical Emergency: 999

Do not rely on Chipon Alert during active emergencies. Call emergency services directly.

4. Community-Sourced Data

Incident reports within Chipon Alert come from community members, not from verified official sources.

We cannot and do not guarantee that:

• All reports are accurate or truthful
• All reports are complete or unbiased
• All reports are timely or current
• Reports cannot be exaggerated, outdated, false, or manipulated by users

Reports may reflect:

• Personal perception rather than objective fact
• Isolated incidents rather than patterns
• Unverified rumors or secondhand information
• Geographic or demographic bias in reporting

The Company does not verify the accuracy of community reports before publication. While we have community verification systems in place, these are crowd-sourced and not foolproof.

You must independently verify any critical information before taking action based on community reports.

5. Third-Party Data Sources

Chipon Alert integrates data from external sources including:

• NBS Nigeria — National Bureau of Statistics crime data
• ACLED — Armed Conflict Location and Event Database (global conflict/violence data)
• HDX — Humanitarian Data Exchange (humanitarian emergencies, flooding, displacement)
• Weather APIs — Third-party weather and meteorological services

We are not responsible for:

• Errors, omissions, or inaccuracies in third-party data
• Outdated or stale data from external sources
• Misinterpretation or misrepresentation of third-party information
• Changes to third-party data that affect App accuracy

Third-party data is aggregated, transformed, and presented as-is. We make no warranties about its completeness, accuracy, or fitness for any purpose.

6. Route Recommendations

Route safety scores, "safest route" recommendations, and route comparisons are informational and automatically generated.

They do NOT account for:

• Real-time traffic or road conditions
• Actual police presence or checkpoints
• Current weather conditions affecting road safety
• Vehicle-specific concerns (fuel, mechanical, roadworthiness)
• Personal mobility limitations or medical conditions
• Time-of-day safety variations beyond historical patterns

You must always:

• Exercise personal judgment when selecting a route
• Consider current conditions before departure
• Remain aware of your surroundings while traveling
• Follow local traffic laws and guidance

The Company is not liable for any injury, loss, or property damage resulting from reliance on route recommendations.

7. No Professional Advice

Chipon Alert provides informational content only and does NOT provide:

• Professional security consulting
• Legal advice or interpretation
• Emergency management planning
• Risk assessment services
• Personal safety coaching
• Professional threat analysis

If you require professional security or emergency management services, consult a licensed professional in your jurisdiction.

8. Technical Limitations

The App is subject to technical constraints:

• GPS Accuracy: GPS location data may be inaccurate by 5–50+ meters depending on environment, device, and network conditions
• Connectivity: The App requires internet connectivity. Safety information may not update in real-time
• Downtime: The App may experience service interruptions, maintenance windows, or unexpected outages
• Bugs & Glitches: The App may contain software bugs that affect accuracy or functionality
• Device Limitations: Performance varies by device type, OS version, and available memory
• Data Sync: Offline data may be stale or inconsistent with the server version

We do not guarantee uninterrupted, error-free service.

9. Limitation of Liability

To the fullest extent permitted by law:

The Company is NOT liable for any direct, indirect, incidental, consequential, special, or punitive damages arising from:

• Your use or inability to use the App
• Reliance on App information, scores, reports, or recommendations
• Loss of life, injury, death, or illness
• Property damage or loss
• Financial loss or economic harm
• Emotional distress or psychological harm
• Business interruption or lost opportunity

This limitation applies regardless of whether the Company was advised of the possibility of such damages and regardless of the legal theory (contract, tort, strict liability, etc.).

This is a comprehensive liability waiver. You acknowledge that the Company would not provide the App without this protection.

10. Indemnification

You agree to indemnify, defend, and hold harmless the Company and its officers, directors, employees, agents, and affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:

• Your use of the App
• Your violation of this disclaimer or applicable law
• Your reliance on App information
• Your actions based on App recommendations or community reports
• Your infringement of third-party rights through App use

11. External Links & Third-Party Content

Chipon Alert may contain links to third-party websites, services, or content. The Company:

• Does not endorse, control, or assume responsibility for third-party content
• Is not liable for any loss or damage caused by third-party websites or services
• Recommends reviewing third-party terms and privacy policies before use

Your use of third-party services is at your own risk and subject to their terms.

12. Jurisdiction & Governing Law

This disclaimer is governed by the laws of the Federal Republic of Nigeria, without regard to conflicts of law principles.

Any legal claim or dispute arising from this disclaimer or the App shall be brought exclusively in the courts of Lagos State, Nigeria.

You consent to the personal jurisdiction and venue of these courts.

13. Severability

If any provision of this disclaimer is found invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it valid, or if not possible, shall be severed. All other provisions remain in full force.

14. Amendment

The Company may update this disclaimer at any time without notice. Continued use of the App after changes constitutes acceptance of the updated disclaimer.
