Chipon Alert — Incident Reporting Liability Waiver

1. Purpose
This Incident Reporting Liability Waiver governs user participation in Chipon Alert's community incident reporting feature. By submitting, verifying, or acting upon community safety reports, you acknowledge the unique risks and responsibilities outlined herein.
Chipon Alert is a preventive safety intelligence platform — not a substitute for emergency services. Community reports are crowdsourced, real-time data shared to help people make informed decisions about their safety.
2. User Acknowledgments
By submitting an incident report to Chipon Alert, you acknowledge and agree that:
2.1 Voluntary Participation
- You are providing information voluntarily and of your own free will
- No one has coerced, pressured, or required you to report
2.2 Community Visibility
- Your report will be visible to other Chipon Alert users in your area
- Reports include location data (GPS coordinates) that will be shared on the community map
- Report details (incident type, description, severity, timestamp, photos) are accessible to the community
- Your identity may be associated with your report (if logged in) or anonymous (if submitted without authentication)
2.3 Accuracy & Responsibility
- You are responsible for the accuracy of information in your report
- You will not knowingly submit false, misleading, or exaggerated information
- You understand that inaccurate reports harm community trust and safety outcomes
2.4 Personal Safety is Priority
- You should NEVER put yourself in danger to report an incident
- Do not approach active crime scenes, fires, accidents, or dangerous situations to document them
- Do not photograph or confront perpetrators, accident victims, or individuals at risk
- Your safety is infinitely more important than a report — report from a safe distance or after the fact
2.5 Emergency Services Still Required
- Reporting on Chipon Alert does NOT substitute for calling emergency services
- For life-threatening emergencies, immediately call:
- Nigeria Police (armed robbery, violence, kidnapping): 112 or 199
- Fire & Rescue: 767
- Medical Emergency: 199
- Community reports are for situational awareness and safety intelligence — not emergency dispatch
- Response times from community verification are measured in minutes to hours; emergency services are measured in seconds
3. Reporter Liability
3.1 False Reports
- If you knowingly submit false, fabricated, or deliberately misleading information, you are liable for consequences arising from that false report
- Other users, businesses, or individuals harmed by your false report may pursue claims against you for damages
3.2 Nigerian Law
- Willfully filing a false report may violate the Cybercrimes Prevention Act, 2015 (sections on false information, cybercrime)
- False reports that incite panic or disrupt public order may expose you to criminal liability
- Penalties may include fines, prosecution, or both
3.3 Defamation & Identification
- If your report names, identifies, or describes a specific individual (by name, photo, location details), you assume full liability for defamation or libel claims
- Do not name individuals unless you are reporting a crime by a known suspect and have reasonable grounds to believe the identification is accurate
- Baseless accusations or implied defamation expose you to civil claims for damages to reputation and emotional distress
3.4 Privacy Violations
- Do not photograph or record individuals without their consent, especially victims, minors, or bystanders
- Violating someone's privacy may expose you to privacy invasion claims or civil suits
- Never share medical information, personal details, or identifiable characteristics of vulnerable individuals
3.5 Assumption of Risk
- By reporting, you assume risk that other users may act on incomplete or outdated information
- You assume risk that your location data becomes associated with the report (location privacy)
- You assume risk that false reports by others may result in you being blamed or targeted
4. Company Liability Waiver
To the fullest extent permitted by law, Jyv Tech LLC and Tanta Innovative Limited are not liable for:
4.1 User Actions Based on Reports
- Actions taken by other users in response to community reports (e.g., avoiding an area, changing routes, reporting to authorities)
- Harm, injury, or loss resulting from user reliance on community reports
- Decisions to approach, investigate, or intervene based on incident reports
4.2 Third-Party Report Accuracy
- The accuracy, completeness, or timeliness of reports submitted by other community members
- Unverified, outdated, or false information in the community report feed
- Reports from unvetted or malicious users
4.3 Verification & Moderation Delays
- Delays in verifying, disputing, or removing reports
- Gaps between report submission and community verification
- Reports that remain visible despite being false or disputed
- Company moderation decisions (to remove, flag, or demote reports)
4.4 Incident Prevention
- Incidents that occur despite community reports being visible
- Incidents that occur in reported locations after the incident has been archived or removed
- Inability to prevent future incidents based on historical reports
4.5 Psychological & Emotional Harm
- Distress, anxiety, fear, or trauma from viewing incident reports
- Exposure to graphic, violent, or upsetting content in reports
- Mental health impacts from repeated exposure to community safety incidents
4.6 Location Privacy Breaches
- Misuse of location data associated with reports
- Third-party tracking or targeting based on incident locations
- Doxxing or harassment based on report locations or reporter identity
4.7 System Availability
- Downtime, data loss, or service interruptions
- Inability to submit, modify, or retrieve reports due to technical failures
- Loss of report history or location data
5. Verification Participant Waiver
If you participate in verifying, disputing, or responding to community reports, you acknowledge:
5.1 Good Faith Participation
- You are acting in good faith to improve report accuracy and community safety
- You are not guaranteeing the accuracy of any report you verify
- Verification is a community consensus mechanism, not a professional fact-check
5.2 No Liability for Verification Decisions
- You are not liable for decisions by other users based on reports you verified or disputed
- You are not liable if a report you verified turns out to be false
- You are not liable if harm occurs despite your verification or dispute
5.3 No Professional Obligation
- You are a volunteer community member, not an employee or agent of Chipon Alert
- You have no legal duty to fact-check, verify, or dispute reports
- You may opt out of verification at any time
6. Photo & Media Waiver
6.1 Consent to Use
- Photos and media submitted with incident reports become part of Chipon Alert's community safety data
- The Company may use submitted media for:
- Community map visualization
- Report verification and trend analysis
- Safety intelligence and heatmap generation
- Internal research on incident patterns
- Aggregate safety analytics (anonymized)
6.2 Content Restrictions
- Do not photograph victims, minors, or identifiable individuals without explicit consent
- Do not submit media that captures emergency responders, police, or security personnel
- Do not submit media that reveals private property, home addresses, or business interiors
- Violation of these restrictions exposes you to privacy and defamation liability
6.3 Company Discretion
- The Company may remove, blur, or redact photos at its discretion
- The Company may refuse to display media that violates privacy, contains identifying information, or is graphic/violent
- Removal of your media does not imply fault by the Company
6.4 Metadata & Privacy
- EXIF data (timestamps, precise GPS coordinates, device info) may be stripped from photos before display
- Stripped metadata is retained internally for verification purposes
- You consent to metadata extraction and storage by the Company
6.5 Third-Party Rights
- You represent and warrant that you have the right to submit all media
- You are responsible for obtaining consent from any identifiable individuals in photos
- You indemnify the Company for claims arising from your media submissions
7. Location Data Consent
7.1 GPS Coordinates Sharing
- Incident reports include GPS coordinates (latitude/longitude) of the reported incident location
- These coordinates are visible to all Chipon Alert users and appear on the community safety map
- You consent to your location data being shared in this manner
7.2 Location Privacy
- Do not report from your home, workplace, or personal location unless the incident occurred there
- Report from a safe distance or public area when possible
- Be aware that your location at time of report may be inferred by other users
7.3 Location Data Retention
- Location data is retained as part of report history for trend analysis
- Archived reports may retain location data for historical safety intelligence
- You cannot revoke location data consent after report submission
8. Personal Safety Warning
⚠️ Your Safety is Non-Negotiable
NEVER approach an active crime scene, fire, accident, or dangerous situation to report or photograph it.
- Active armed robbery, shooting, or violent crime in progress → Stay away. Call 112/199. Do not investigate.
- Active fire or structural collapse → Stay away. Call 767. Do not approach.
- Major traffic accident with injuries → Stay away. Call 199. Do not obstruct rescue.
- Protests, riots, or civil unrest → Avoid the area. Report from a safe distance or after the fact.
- Flooding or environmental hazard → Do not wade into hazardous water. Report location from safe ground.
You can report an incident:
- From a safe distance (50+ meters away)
- After emergency responders have secured the scene
- Based on information you heard or witnessed, without approaching
- By calling Chipon Alert after you've reached safety
Your personal safety is infinitely more important than providing real-time incident details. Emergency services will respond regardless of your photo or video. Report when safe; do not create secondary emergencies.
9. Indemnification
9.1 Mutual Indemnity
You agree to indemnify, defend, and hold harmless Jyv Tech LLC, Tanta Innovative Limited, and their respective officers, directors, employees, and agents from any and all claims, damages, liabilities, costs, or expenses (including legal fees) arising from:
- Your incident reports (false, defamatory, inaccurate, or harmful)
- Your submission of media, photos, or identifying information
- Your violation of these terms or applicable laws
- Your participation in verification or dispute of reports
- Third-party claims of privacy invasion, defamation, or harassment based on your reports
9.2 Company Indemnity (Limited)
The Company indemnifies you against claims that your submission of factual, good-faith incident information (without identifying individuals or violating privacy) is defamatory, provided you have not acted recklessly or with malice.
10. Assumption of Risk
You acknowledge and assume all risks associated with:
- Submitting incident information to a crowdsourced platform
- Location data exposure and privacy considerations
- Reliance on unverified community reports
- Potential harassment or targeting based on your reports
- Psychological impact of viewing real-time safety incidents
- Changes to Chipon Alert's policies, features, or service availability
11. Severability
If any provision of this waiver is found unenforceable by a court of competent jurisdiction, that provision shall be severed, and the remaining provisions shall remain in full force and effect.
12. Governing Law & Jurisdiction
This waiver is governed by the laws of the Federal Republic of Nigeria, without regard to conflict of law principles.

- Applicable Law: Nigerian Criminal Code Act, Cybercrimes Prevention Act 2015, and general common law principles

14. Acknowledgment
By submitting your first incident report to Chipon Alert, you affirmatively acknowledge that you have read, understood, and agree to be bound by this Incident Reporting Liability Waiver.
Your continued use of the community reporting feature constitutes ongoing acceptance of these terms.
