1. Respect for Intellectual Property
Chipon Alert (operated by Jyv Tech LLC globally and Tanta Innovative Limited in Nigeria) respects the intellectual property rights of others and expects our users to do the same.
Our platform allows community members to submit incident reports, photos, descriptions, and safety information to help others understand neighborhood safety conditions. All user-submitted content remains subject to applicable copyright and intellectual property laws.
We do not tolerate copyright infringement, plagiarism, or unauthorized use of protected works on our platform. Users who submit content warrant that they own or have proper authorization to share that content. Unauthorized reproduction of copyrighted material—including photos, text, or other media—is prohibited.
2. DMCA Takedown Procedure
2.1 How to File a Copyright Infringement Notice
If you believe your copyrighted work has been infringed on the Chipon Alert platform, you may submit a Digital Millennium Copyright Act (DMCA) takedown notice to our Designated Copyright Agent. We will investigate promptly and take appropriate action, up to and including removal of infringing content and suspension of user accounts.
2.2 Required Elements of a DMCA Notice
To be valid, your notice must include all of the following (per 17 U.S.C. § 512(c)(3)):
Your physical or electronic signature — Demonstrating that you are authorized to act on behalf of the copyright owner.
Identification of the copyrighted work — Describe the copyrighted work(s) being infringed. If multiple works are involved, provide a representative list.
Identification of the infringing material — Provide specific locations on the Chipon Alert platform where the infringing content is located. Include direct URLs, incident report IDs, user handles, or other precise identifiers that allow us to locate the material.
Your contact information — Provide your name, mailing address, telephone number, and email address.
Statement of good faith belief — Include the following statement:
"I have a good faith belief that the use of the material identified above is not authorized by the copyright owner, its agent, or the law, and that the information in this notice is accurate."
Statement regarding accuracy and perjury — Include the following statement:
"I hereby state that I am the copyright owner or am authorized to act on the copyright owner's behalf, and under penalty of perjury (18 U.S.C. § 1746), I certify that the information contained in this notice is accurate and that I have the right to enforce the copyright in question."
Verification of authority — If you are acting on behalf of the copyright owner (rather than as the owner yourself), provide documentation of your authority to represent them.
2.3 Sending Your DMCA Notice

We recommend sending notices by email to ensure timely receipt and processing.
2.4 Processing and Response
Upon receipt of a valid DMCA notice, we will:
- Acknowledge receipt of your notice within 2 business days.
- Investigate the claim to verify the infringement.
- Remove or disable access to allegedly infringing content if we determine the notice is valid.
- Notify the affected user of the takedown action and provide them with a copy of your notice.
- Respond to you with confirmation of actions taken, typically within 5-10 business days.
Note: Incomplete or deficient notices will not be processed. We may request clarification or additional information to proceed.
3. Counter-Notification Procedure
3.1 User Right to Counter-Notify
If your content has been removed following a DMCA takedown notice, and you believe the removal was in error or unjustified, you have the right to submit a counter-notification.
3.2 Required Elements of a Counter-Notification
To be valid, your counter-notification must include all of the following (per 17 U.S.C. § 512(g)(3)):
Your physical or electronic signature.
Identification of the removed content — Describe the material that was removed and where it was located on the platform (incident report ID, location, etc.).
Your statement under penalty of perjury — Include the following statement:
"I declare under penalty of perjury (18 U.S.C. § 1746) that I have a good faith belief that the material was removed or disabled as a result of mistake or misidentification, and that the content does not infringe any copyright or other intellectual property right."
Your consent to jurisdiction — Include the following statement:
"I consent to the jurisdiction of Federal District Court for the judicial district in which my address is located [or if outside the U.S., equivalent applicable jurisdiction], and I will accept service of process from the person who provided the DMCA notice or an agent of such person."
Your contact information — Provide your name, mailing address, telephone number, and email address.
3.3 Submitting Your Counter-Notification

3.4 Processing Counter-Notifications
Upon receipt of a valid counter-notification, we will:
- Acknowledge receipt within 2 business days.
- Notify the original copyright claimant of your counter-notification.
- Advise them of legal remedies available if they wish to pursue the claim further.
- Restore the content after 10-14 business days if the copyright claimant does not file a court action.
Note: If the copyright holder files a lawsuit, we will not restore your content unless instructed by a court order.

5. Nigerian Copyright Act Compliance
Chipon Alert also operates Tanta Innovative Limited as a subsidiary in Nigeria and respects rights under the Nigerian Copyright Act, 2022 and related Nigerian intellectual property law.
5.1 Scope in Nigeria
Nigerian copyright law protects:
- Original literary, dramatic, musical, and artistic works
- Sound recordings and cinematograph films
- Broadcasts and typographical arrangements
- Database compilations
Users in Nigeria or submitting content about Nigerian locations must comply with the Copyright Act, 2022.
5.2 Infringement Claims in Nigeria
Copyright holders in Nigeria may file infringement claims under the same DMCA procedure outlined above. We will evaluate claims under both U.S. copyright law (17 U.S.C.) and Nigerian law, as applicable.
5.3 Fair Dealing and Fair Use
Chipon Alert recognizes that some uses of copyrighted material may be lawful under fair dealing provisions (Nigerian Copyright Act, 2022, Sections 31–34) or fair use doctrine (17 U.S.C. § 107), including:
- Educational use
- Commentary and criticism
- News reporting
- Transformative parody
Claimants asserting infringement should consider whether the use qualifies as fair dealing or fair use before filing a notice.
6. Repeat Infringer Policy
6.1 Account Suspension
Chipon Alert maintains a zero-tolerance policy for repeat copyright infringers. Users who:
- Submit multiple copyrighted works without authorization,
- Ignore takedown notices and repost removed content, or
- Demonstrate a pattern of copyright infringement
...may have their accounts suspended or terminated without warning.
6.2 Documentation
We maintain records of all DMCA notices and takedown actions. Users with repeated valid claims against them may be permanently banned from the platform.
6.3 Exceptions
Accounts will not be terminated for:
- Single good-faith mistakes or misunderstandings.
- Disputed claims where a valid counter-notification is filed.
- Content removed in error and successfully restored.
7. Good Faith Requirement
All parties submitting DMCA notices, counter-notifications, or infringement claims must do so in good faith. False or fraudulent notices are subject to legal liability, including damages, attorney fees, and costs.
7.1 Penalties for Abuse
Users or claimants who:
- File knowingly false DMCA notices,
- Submit counter-notifications they know to be false,
- Use the DMCA process for harassment or competitive advantage,
...may face legal action and damages under 17 U.S.C. § 512(f).
7.2 Our Right to Challenge
Chipon Alert reserves the right to challenge the validity of any DMCA notice or counter-notification that appears deficient, fraudulent, or filed in bad faith.
8. User-Generated Content Ownership
8.1 Incident Reports and Photos
When users submit incident reports, photos, descriptions, or comments on the Chipon Alert platform:
- Users retain ownership of their original content.
- Users grant Chipon Alert a royalty-free, worldwide, perpetual license to display, analyze, and distribute the content for safety intelligence purposes.
- Chipon Alert does not claim ownership of user photos or submissions.
8.2 Third-Party Content
Users must not submit:
- Photos taken by others without permission.
- Copyrighted text, articles, or publications.
- Branded logos or trademarks used without authorization.
- Screenshots or excerpts from news articles or media (unless fair use applies).
Users are solely responsible for ensuring their submissions do not infringe third-party rights.
9. Limitations and Disclaimers
9.1 No Legal Judgment
Chipon Alert makes no determination of copyright validity when processing DMCA notices. We remove or disable access to content based on the formality and apparent validity of notices received, without making legal conclusions about fair use, fair dealing, or other defenses.
9.2 Expedited Removal
We may remove content expeditiously to comply with the DMCA, even if the claim is later determined to be invalid. Users have the right to file counter-notifications to challenge removals.
9.3 No Warranty
Chipon Alert provides this policy and DMCA process "as-is." We make no warranty regarding the accuracy, completeness, or timeliness of our processing. We are not liable for delays, errors, or third-party claims arising from DMCA notices or counter-notifications, except as required by law.

11. Policy Changes
Chipon Alert reserves the right to modify this policy at any time. Material changes will be posted with an updated "Last Updated" date. Continued use of the platform constitutes acceptance of the updated policy.
12. Governing Law
This policy is governed by the laws of the United States (for DMCA provisions) and the laws of Nigeria (for Nigerian Copyright Act compliance). Any disputes arising under this policy shall be resolved in accordance with the terms of the Chipon Alert Terms of Service.
